Boro valued Ziege at £7.5m and had received bids from two clubs for that value but Liverpool persued a clause in Ziege's contract that allowed transfer negotiations to take place if a bid of £5.5m was received.
In court today David Phillips QC, representing Boro, claimed that Liverpool had exploited confidential knowledge of Ziege's Boro contract. He went on to claim Ziege was happy at Boro and would not have moved had Liverpool not made their approach.
A judgement is expected as early as tomorrow.

Liverpool were fined £20,000 and Ziege £10,000 by the Premier League back in March when a Premier League commission found Liverpool and Ziege guilty of irregularities over his transfer to Liverpool from Boro two years ago.
